The Colgate settlement benefits consumers who purchased Tom’s of Maine brand toothpaste products between Nov. 21, 2020, and March 6, 2026. According to a class action lawsuit, an FDA inspection revealed that Tom’s of Maine failed to meet the FDA’s “Current Good Manufacturing Processes.” Despite these findings, Colgate-Palmolive allegedly continued to market Tom’s of Maine toothpaste as “naturally sourced” and “naturally effective.” Tom’s of Maine is a Colgate-Palmolive toothpaste brand marketed as a natural alternative to traditional toothpaste. Colgate-Palmolive has not admitted any wrongdoing but agreed to pay $2.9 million to resolve the allegations. Under the terms of the Colgate settlement, class members can receive a cash payment based on the number of products they purchased and whether they have proof of purchase. With proof of purchase, class members can receive a full refund for up to three purchased Tom’s of Maine toothpaste products. Without proof of purchase, class members can receive a payment based on the average retail price of one Tom’s of Maine product. If the total value of all approved claims exceeds the funds available for distribution, payments may be reduced on a pro rata basis. If the total value of all approved claims is less than the funds available, the remaining funds will be donated to Equal Justice Works. The deadline for exclusion and objection is July 6, 2026. The final approval hearing for the Tom’s of Maine class action settlement is scheduled for Sept. 10, 2026. To receive a settlement payment, class members must submit a valid claim form by July 6, 2026.
