Anyone who applied for or held a Capital One credit card between 2005 and 2019 and was notified their data was compromised.
- Capital One credit card holders or applicants between 2005-2019
- Must have received a data breach notification from Capital One
- Can claim documented out-of-pocket losses up to $25,000
- California and other state residents may have additional claims
Proof Requirements
For basic claims, no proof is needed. For claims above the base amount, you must provide documentation of:
- Time spent dealing with the breach (valued at $25/hour, up to 15 hours)
- Out-of-pocket expenses related to the breach
- Evidence of identity theft or fraud resulting from the breach
Settlement Details
In July 2019, Capital One discovered that a hacker had accessed personal information of approximately 100 million Capital One credit card customers and applicants. The compromised data included names, addresses, phone numbers, email addresses, dates of birth, and self-reported income.
For approximately 140,000 customers, Social Security numbers were also compromised. Additionally, about 80,000 customers had their linked bank account numbers exposed.
