Missing Settlement Deadlines: The $6 Billion Problem (And How to Avoid It)

In 2024, approximately $6.2 billion in class action settlement funds was returned to defendants or donated to cy pres charities because eligible class members never filed claims. This is money those consumers were legally entitled to — money they simply didn't know about or, more commonly, forgot about before the deadline passed.

Why Do People Miss Settlement Deadlines?

1. They Never Found Out

Class action notice requirements are designed to be legally adequate, not consumer-friendly. A settlement affecting 20 million people might be announced through a small newspaper notice, a mailed postcard that looks like junk mail, and a temporary website. Many legitimate class members never receive adequate notice.

2. The Deadline Was Months Away

Settlement claim periods are often 90–180 days long. People find out about a settlement, think "I'll do this later," and then forget. The deadline passes. The money goes unclaimed.

3. They Assumed It Was a Scam

The Three Types of Settlement Deadlines
