The $650 Million Facebook Illinois BIPA Settlement
In 2021, Facebook paid $650 million to settle a class action lawsuit in Illinois under the Illinois Biometric Information Privacy Act (BIPA). The case alleged that Facebook's "Tag Suggestions" feature — which automatically identified and tagged people in photos using facial recognition — collected and stored biometric identifiers without proper consent. Illinois residents who used Facebook between June 2011 and August 2020 were eligible to file a claim and received approximately $397 each. While the main claims period has closed, Facebook continues to face biometric privacy litigation in other states.
