The LINQ class action settlement benefits individuals who received a written notification that their personal information was potentially accessed, viewed and/or obtained as a result of the EMS LINQ data breach between Sept. 12, 2023, and May 13, 2024. The LINQ data breach allegedly compromised sensitive employee and student data, such as names, addresses, dates of birth, bank account information and Social Security numbers, according to a class action lawsuit against EMS LINQ. EMS LINQ is a data management company that provides services to school districts and other organizations. EMS LINQ has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the class action lawsuit against it. Under the terms of the LINQ settlement, class members can receive up to $500 for documented ordinary losses, such as bank fees, communication charges and travel expenses. Class members can also receive up to $2,500 for documented extraordinary losses, such as unreimbursed fraudulent charges and identity theft losses. Class members who do not have documented losses can receive a $50 alternative cash payment. All class members are eligible for one year of free three-bureau credit monitoring. The deadline for exclusion and objection is May 29, 2026. The final approval hearing for the EMS LINQ data breach settlement is scheduled for June 23, 2026. To receive settlement benefits, class members must submit a valid claim form by June 29, 2026.
